Think of your Owner’s Land Title as the key to your property’s value ![]()

Without that key, the value is locked. It will be difficult to sell, mortgage, or transfer it.
The good news is, your ownership is still safe. The official legal process is how we get a new key made, giving you back full control and access.
Philippine law, specifically Presidential Decree No. 1529 (the Property Registration Decree), outlines the mandatory procedure for securing a replacement. This process involves two distinct and critical stages:
1. Administrative Notice
The first and most urgent step is the execution of a sworn Affidavit of Loss. This document must be promptly filed with the corresponding Registry of Deeds where the property is located. This action serves as an official notice to the public and is a crucial administrative safeguard against the potential fraudulent use of the lost certificate.
2. Judicial Proceeding
This is a mandatory judicial proceeding filed before the Regional Trial Court. Its purpose is to have the court, after due notice and hearing, formally declare the owner’s duplicate certificate as lost and order the Registry of Deeds to issue a new one in its place.
The intricacies of this judicial process require meticulous preparation of evidence and strict adherence to procedural rules.
